TERMS AND CONDITIONS

GENERAL:

EVENTS PARTY RENTAL, shall not be liable and shall be held harmless in any manner for injures or damages caused to persons or property by any rented equipment or part thereof such as, but not limited to poles, tents, lights, ropes, stakes or or tie downs.

SET-UP AND DELIVERY:

All set-up dates and time will be estimated and scheduled a few days prior to your event and as much as we do our best to stay on schedule please keep in mind those estimated times may change due to a variety of circumstances out of our control.

WEATHER POLICY:

Events Party Rental reserves the right to delay or cancel set-up and/or removal of the rental equipment if we feel it is unsafe or due to severe weather, or a severe weather warning. IMPORTANT! Our rental tents were manufactured for use as a temporary structure. The structure should not be considered safe when severe weather, including, but not limited to, heavy rain, high winds or lightning is present or approaching.. If severe weather is present or approaching, we require evacuating the structure, and that all occupants seek shelter in an appropriate location until the storm/severe weather and warning has passed. If at any time you or your guests feel unsafe under or around the structure for any reason, they should leave the structure immediately. Events Party Rental, shall not be liable and shall be held harmless for injuries or damages from any cause including, but not limited to: rain, hail, snow, storms, winds, floods, or any other act of nature. PLEASE NOTE: When winds reach 35 MPH we recommend evacuating all tents and seeking safety in permanent structures.

UNDERGROUND UTILITIES AND EQUIPMENT:

We are required to drive stakes into the ground to properly secure your tent. It is the customer’s responsibility to have marked the locations of all underground utilities, sprinklers, septic fields/tanks or any other underground equipment. Events Party Rental, it's employees or contractors will not be held responsible for any damage caused to any underground utilities, sprinkler equipment, sewer lines, or any other items that have not been properly marked. Please coordinate with us to let us know when you will be having the utilities marked.

DEPOSITS:

Deposits are required to schedule and secure equipment and/or an event date. Deposits are non-refundable, but can be used towards a rescheduled event or a different rental during the same calendar year.

FIRES, FIREWORKS, GRILLS OR COOKING:

Under no circumstances are fires, fireworks, ash producing lawn candles, grilling, or any sort of cooking be permitted under, around or within 20 feet of the tent. The customer will be responsible for cleaning fees or total replacement if such misuse takes place.

TAPES OR ADHESIVES OF ANY KIND:

Under no circumstances is tape or any other adhesive substance permitted to be attached or stuck to the tent canopy or poles at any time! The customer will be responsible for cleaning fees or total replacement if such misuse takes place.

PRIVATE PROPERTY EVENTS AND PERMITS:

If setting up at commercial type property or a property being rented or leased, it is the customers responsibility to seek permission from that land owner to setup on the property. If permits are required to set up tents in the town or location you are planning your event the customer is required to procure and or schedule any permits, fees, inspections required.

SOD/GRASS/ASPHALT/CONCRETE:

Events Party Rental nor it's staff will not be held responsible for any damage caused to the sod, grass, asphalt, plants, trees, asphalt, concrete, deck, patio, or similar materials. Out crews have been taught to minimize damage to plants, grass, flowers, and sod.

EQUIPMENT DAMAGE OR ABUSE:

We do not hold our customers responsible for equipment failure from normal use and when our equipment has been used as instructed. However, the customer is responsible for any damage caused due to abuse or misuse of our equipment while in their possession. The customer is not permitted to set-up, move, adjust, or repair the rental tents. If repair or replacement of our equipment is necessary due to misuse whether by them or anyone present at their event, the customer will be charged accordingly for repair or replacement. IMPORTANT!! Chemicals like silly string type substances will often cause permanent staining of our tent canopies and sidewalls. If any damage is present at the time of pick-up we require the fees necessary for repair or replacement of the equipment in cash or check within 7 days of your reservation. No one including the customer, their guests, or anyone attending the event is ever permitted to stand on any rented equipment including, but not limited to tables, chairs or tents.

EQUIPMENT CONDITIONS AND CLEANING:

We expect our tables and chairs to be returned to us in the condition delivered. Please note: as much as it is important to us to keep our equipment clean and in it's best condition, rented equipment may have some marks or stains. Our company prides itself on clean tents as we use drop cloths to keep the tents clean and bags to protect the wood chairs. Tents, gutters and sidewalls are temporary structures and as much as they are designed to keep water and wind out sometimes they may find their way into the tent through small openings or lace lines. Heat units are designed to heat tents with the use or propane fuel and thermostats and at times the equipment, for whatever reason may fail. As this is very rare the best solution is to rent two heat units for a tent as a back up. Lighting rented may for whatever reason fail due to circumstances beyond our control, including, but not limited to fuse box breakers over loading. Events Party Rental can not be held responsible for any equipment failure out of their control. We will also do our best to rectify any failed equipment situation as soon as possible once we are notified. We do test all equipment rented to make sure it is in working condition the day of the setup. In some rare instances, Events Party Rental reserves the right to sublease equipment if necessary or hire outside vendors in order to complete projects. Tent size substitutions may also be necessary for reasons out of our control or substitute tent sizes to satisfy the order.

ATTORNEYS' FEES AND COSTS:

If any legal action or other proceeding is brought in connection with this Agreement, Events Party Rental, if the prevailing party, shall be entitled to recover reasonable attorneys’ fees and other related costs, in addition to any other relief to which our company is entitled. In the event that it is the subject of dispute, the court or trier of fact who presides over such legal action or proceeding is empowered to determine if our company is the prevailing party in accordance with this provision.

ENTIRE AGREEMENT:

This Agreement contains the entire agreement between the Parties related to the matters specified herein, and supersedes any prior oral, emailed or written statements or agreements between the Parties related to the contents of this Agreement.

ENFORCEABILITY, SEVERABILITY, AND REFORMATION:

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable but that by limiting such provision it would become valid and enforceable then such provision shall be deemed to be written, construed and enforced as so limited. The intent of the Parties is to provide as broad an indemnification as possible under Illinois law. In the event that any aspect of this Agreement is deemed unenforceable, the court is empowered to modify this Agreement to give the broadest possible interpretation permitted under Illinois law.

APPLICABLE LAW:

This Agreement shall be governed exclusively by the laws of Illinois, without regard to conflict of law provisions.

EXCLUSIVE VENUE AND JURISDICTION:

Any lawsuit or legal proceeding arising out of or relating to the Agreement in any way whatsoever shall be exclusively brought and litigated in the state courts of Illinois. Each Party expressly consents and submits to this exclusive jurisdiction and exclusive venue. Each Party expressly waives the right to challenge this jurisdiction and/or venue as improper or inconvenient. Each Party consents to the dismissal of any lawsuit that they bring in any other jurisdiction or venue.

INDEMNIFICATION:

To the fullest extent of the law, customer shall fully defend, indemnify and hold harmless Events Party Rental from any and all claims, lawsuits, demands, causes of action, liability, loss, damage and/or injury, of any kind whatsoever, including without limitation all claims for monetary loss, property damage, equitable relief, personal injury and/or wrongful death, whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local government body or agency, arising out of, in any way whatsoever, any acts, omissions, negligence, or willful misconduct on the part of the customer and/or Events Party Rental, its officers, owners, personnel, employees, agents, contractors, invitees, or volunteers. This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgments, awards, decrees, attorneys’ fees, and related costs or expenses, and any reimbursements to Homeowner for all legal fees, expenses and costs incurred by it.

AGREEMENT:

This Agreement shall be instated on behalf of the customer and/or their representative and effective once the deposit has been made. The customer and/or their representative acknowledges he/she is authorized to enter into this Agreement. Events Party Rental will set up the tents, tables and chairs according to the layout provided by the customer or one of their vendors such as a party planner or caterer. The layout plan must be sent to Events Party Rental at least one day prior to the setup date or Events Party Rental will set up the equipment in it's best judgement. Customers having chairs set up at Arbor on a day that may rain must let Events Party Rental know 4 hours in advance as to whether they want the chairs moved inside to the Lodge's upper level. If Events Party Rental is not notified within the time frame CTR will make a judgment call as to the best location for the equipment. If the client requests a change of location of equipment after Events Party Rental has set up any equipment there will be a $75 per man hour charged to the customer. Events Party Rental does not guarantee that they will be able to move any equipment after initial set up. Any and all decorations or equipment set up on behalf of the customer must be taken down the night of the event as Events Party Rental works on a very tight set-up and take-down schedule. Any decorations that have to be taken down by our crew will be billed at $75 per man hour. Please note: Events Party Rental is not responsible for electrical failures from overloaded circuits or power outages or from any other reason.
